These general terms & conditions govern the offer of services.
Any customer of ms-transfert.com must be aware of these terms & conditions before booking a car.

Any reproduction, representation or distribution of all or part of the Website, by any means whatsoever and on any medium whatsoever, is prohibited and may be subject to prosecution, except express written permission of MS Transfert.

These documents must not be copied or distributed on a computer network or on any other media, or contractual and commercial supports.

ARTICLE 1 : DEFINITIONS AND FIELD OF APPLICATION

Is designated by the «customer» any person booking a car on the Website ms-transfert.com.
The term «passenger» means any person using transportation service.

With Ms-transfert.com, you can book a vehicle with private driver for all your travels in France and Europe.

Ms-transfert.com offers 3 main types of services :
— The private transfer service (airport, station, hotel, home …): this is a transport service whose departure place and arrival place are previously informed and defined by the Customer,
— The hourly service: the passenger can book a vehicle with driver or the duration of your stay or just a few hours,

— The concierge service : it is an additional service of which the nature and the services requested are previously informed and defined by the Customer.

ARTICLE 2 : BOOKING ONLINE CONDITIONS

To book one or more transport services offered on the website ms-transfert.com, the Customer agrees to have read and understood the service details and practical information before the validation of his booking and is invited to follow the following steps :

– choice of the type of services,
– price calculation,
– choice of the type of vehicle,
– name of the passenger(s),
– choice of the pick up place and the drop off place,
– summary,
– personal informations confirmation (invoice address, name, first name etc…)

ARTICLE 3 : RATES

The prices are denominated in euros et are all taxes included (TTC). Rates are based on current economic conditions, schedules and the type of service selected. They can evolve at any time.
The initial rate can be amended the day of the service (for example: number of passengers, duration of the service, additional kilometers, change of destination, etc.). Tipping is not included in the rate and the Client can give the driver a tip according his wish.

ARTICLE 4 : TERMS OF PAYMENT

If the customer is an individual, the payment of services is made at the time of booking, on the website.
If the customer is a supplier or a service provider, the payment of the services is made at the latest on the last day of the payment deadline mentioned on the invoice (or thirtieth day following the invoice date or the date of the beginning of the service – article L.144-6 du code de commerce).
No discount will be given for advance payments.
Important: in case of late payment, a fixed compensation will be applied for recovery costs of 40 € (article D. 441-5 du code du commerce).

ARTICLE 5 : CANCELLATION CONDITIONS

Any cancellation request of a service must be sent at least 48 hours before the date of the beginning of the service by email to the commercial service MS Transfert (email on MS Transfert’s Website) :

— 100% refunded  if you cancel more than 48 hours before the beginning of the service,

— 50% refunded if you cancel less than 48 hours and more than 12 hours before the beginning of the service,

— 0% refunded if you cancel less than 12 hours before the beginning of the service.

ARTICLE 6 : TRANSPORTATION CONDITIONS

MS Transfert undertakes to accommodate the passenger in accordance with the terms specified in the practical information of each service.
All our vehicles are non-smoking (loi du 17 septembre 1977).
Animals are not allowed in our vehicles.
In case of unavailability of the chosen vehicle, MS Transfert reserves the right to make available to the Passenger a vehicle of the same category or higher category.
MS Transfert reserves the right to refuse any person deemed unfit (for example : drunkenness, verbal or physical abuse …), which may result in a safety breach for all persons in the vehicle as well as other users of the road.
The transport services booked on ms-transfert.com are carried out by a transportation company, holder of the licenses delivered by the prefecture, of insurance for people transportation for valuable consideration, authorizations and / or certificates of aptitude provided by the regulations specific to this activity and supporting the safety obligations towards the persons transported.
For any type of service, MS Transfert is committed to the use of vehicles in perfect working order and cleanliness.

ARTICLE 7 : RESPONSABILITIES

MS Transfert may not be held liable for :
– theft, loss or neglect of personal effects and luggage left in vehicles,
– driver lateness due to particular conditions (for example: strikes, demonstrations, climatic conditions, important difficulties of circulation, traffic jam due to an accident on the hightway).

The passenger must ensure that he is in possession of an up-to-date identity card before boarding the vehicle.
MS Transfert reserves the right to cancel or modify services without any obligation of notice if the comfort and / or safety of the Passenger requires it.

Only complaints received within the eight days following the transportation service are admissible.

ARTICLE 9 : CONFIDENTIALITY

MS Transfert undertakes to respect the confidentiality of the personal data communicated by the Customer on this website (la loi française Informatique et Liberté n°78-17 du 6 Janvier 1978). As such, the company MS Transfert undertakes not to disclose to third parties the personal information provided by the User on this website and to use it only for the processing of the reservation.

In accordance with the French Data-processing and Freedom law n ° 78-17 of January 6th, 1978, the Customer can exercise a right of access to his file and a right of rectification and / or suppression for the information concerning him by sending his request near MS Transfer customer service.
